CONSENT ITEMS (Consent Items are considered routine Town business and may be approved by one motion. Any member of the Council may remove an item from the Consent Items for comment and action. Members of the public may provide input on any or multiple Consent Item(s) when the Mayor asks for public comments on the Consent Items. If you wish to comment, please follow the Participation Instructions located at the end of this agenda. If an item is removed, the Mayor has the sole discretion to determine when the item will be heard. Each speaker is limited to no more than three (3) minutes or such time as authorized by the Mayor.)
RECOMMENDATION: Approve the Minutes of the June 16, 2026, Town Council Meeting.
RECOMMENDATION: Approve the Minutes of the June 23, 2026, Closed Session Town Council Meeting.
RECOMMENDATION: Authorize the Town Manager to Execute the Fifth Amendment to the Agreement for Services with Traffic Management, Inc., increasing the contract amount by $43,006.15 for the 2026 Halloween and Children’s Holiday Parade road closures and traffic control services, for a total contract amount not to exceed $178,406.79 and extend the period of performance to August 31, 2027.
RECOMMENDATION: Approve a Fourth Amendment to the Agreement for Services with Brightview Tree Care Services, Inc. to retroactively increase Fiscal Year 2025–26 compensation by $41,117 for services already performed, increase the total agreement amount from $1,076,115 to $1,117,232, authorize payment of properly documented invoices within the amended contract amount, and authorize the Town Manager to execute the amendment.
RECOMMENDATION: Authorize the Town Manager to execute the Third Amendment to the Agreement for Services with H.A. Bowen Electric, Inc., increasing compensation by $7,000 for a total agreement amount not to exceed $152,335.
Find that formal competitive bidding for the purchase of library books and other published materials would be impractical, would cause unnecessary expense or delay, and would be unlikely to result in a lower price pursuant to Town Code Section 2.50.130(b)(3); waive the formal bidding requirement; and authorize the Library Department to purchase library books and other published materials from Ingram during Fiscal Year 2026–27 in an aggregate amount not to exceed $132,800.
RECOMMENDATION: Authorize the Town Manager to execute a fifth amendment to the contract for legal services with the law firm of Atchison, Barisone & Condotti to increase the contract amount by $10,000 from $340,000 to a cumulative contract amount not to exceed $350,000 for the entire contract term beginning in December 2022 and ending June 30, 2026.
RECOMMENDATION: Approve the revisions to the Town’s Investment Policy as recommended by the Finance Commission.
RECOMMENDATION: Receive the Monthly Financial and Investment Report for May 2026.
RECOMMENDATION: Approve the Accounts Payable Check Registers dated June 12, June 19, June 26, July 3, July 10, July 17, and July 24, 2026, and ratify and approve the Payroll Reports dated June 12, June 26, July 10, and July 24, 2026
RECOMMENDATION: Adoption of resolution establishing a policy which delegates tort liability claims handling responsibilities to the California Joint Powers Insurance Authority (CJPIA)
RECOMMENDATION: Review, consider, and approve the Town of Los Gatos response to the Santa Clara County Civil Grand Jury report titled "Pothole Damage: Improving claims processes within Santa Clara County"; authorize the Mayor to sign the transmittal letter; and direct staff to submit the response to the Presiding Judge of the Superior Court, file the response with the Town Clerk, and take related administrative actions required by law.
RECOMMENDATION: Review, consider, and approve the Town of Los Gatos response to the Santa Clara County Civil Grand Jury report titled "VTA’s Management and Oversight of BART Silicon Valley Phase II"; authorize the Mayor to sign the transmittal letter; and direct staff to submit the response to the Presiding Judge of the Superior Court, file the response with the Town Clerk, and take related administrative actions required by law.
VERBAL COMMUNICATIONS (Members of the public are welcome to address the Town Council on any matter that is not listed on the agenda and is within the subject matter jurisdiction of the Town Council. The law generally prohibits the Town Council from discussing or taking action on such items. However, the Council may instruct staff accordingly. Town resources may not be used to facilitate audio or visual presentations. To ensure all agenda items are heard, this portion of the agenda is limited to 30 minutes. In the event additional speakers were not heard during the initial Verbal Communications portion of the agenda, an additional Verbal Communications will be opened prior to adjournment. Each speaker is limited to no more than three (3) minutes or such time as authorized by the Mayor.)
PUBLIC HEARINGS (Presentations during the Public Hearings portion of the agenda by appellants and applicants, including any expert or consultant assisting with the presentation, shall be limited to a total of no more than five (5) minutes for all speakers. Appellants and applicants shall be provided no more than three (3) minutes to rebut at the end of the public hearing. Visual presentations that require the use of staff resources shall be limited to appellants and applicants. Members of the public testifying at public hearings shall be limited to no more than three (3) minutes, or such time as authorized by the Mayor.)
RECOMMENDATION: Staff recommends that Town Council conduct a public hearing to consider objections to the 2026 Weed Abatement Program Assessment Report and adopt a resolution confirming the report and authorizing the collection of assessment charges.
Ordinance Title: An Ordinance of the Town Council of the Town of Los Gatos Amending Chapter 29, Zoning Regulations, of the Town Code Regarding Accessory Dwelling Units and Definitions.
RECOMMENDATION: Accept the Planning Commission’s recommendation and introduce an Ordinance amending Chapter 29 (Zoning Regulations) of the Town Code regarding accessory dwelling units and definitions.

Ordinance Title: An Omnibus Ordinance of the Town Council of the Town of Los Gatos Amending the Town of Los Gatos Town Code to Correct Grammatical Errors, Clarify Language, Conform the Codes to Current State Law, Conform Codes to Administrative Practices and Facts, and to Make Other Administrative, Technical, and Non-Substantive Amendments
RECOMMENDATION: Introduce an ordinance amending various sections of the Town of Los Gatos Municipal Code to correct grammatical errors, clarify existing provisions, ensure consistency with current State and Federal Law, and make administrative, technical, and non-substantive changes.
RECOMMENDATION: Receive information regarding electronic pet containment and the Town’s existing fence regulations and provide direction to staff.
RECOMMENDATION: Review the requests for supplemental Sustaining Grant funding; allocate the available supplemental funding; and determine whether CASSY should remain a Sustaining Grant recipient for FY2026-27.
