CONSENT AGENDA
All Consent Agenda items are considered routine, to be enacted by one motion with the adoption of the Consent Agenda,
and without discussion. If a Council Member requests discussion of an item, the item may be removed from the
Consent Agenda and considered separately. The Mayor will present the Consent Agenda
to be set prior to taking action on the following items:
Motion to receive and accept the resident advisory board attendance reports for quarter two (2), which includes January through June, of calendar year 2025.
Motion to approve a Renewal and Amendment No. 3 of Americans with Disabilities Act (ADA) Paratransit Services Agreement, between Wake County and the Town of Apex, effective July 1, 2025 through June 30, 2026, for GoApex Route 1 Bus also known as GoApex Door to Door, and authorizing the Town Manager to execute, or their designee, on behalf of the Town.
Motion to ratify a (1) one-year service agreement between the KONE, Inc and the Town of Apex, to provide elevator maintenance, repair, and emergency communication services for Mason Street Municipal Building, effective July 1, 2025 through June 30, 2026, and to authorize the Town Manager, or their designee, to execute on behalf of the Town.
Motion to adopt a Resolution Directing the Town Clerk to Investigate Petition Received, to accept the Certificate of Sufficiency by the Town Clerk, and to adopt a Resolution Setting the Date of a Public Hearing for August 26, 2025, on the Question of Annexation - Apex Town Council's intent to annex 6.40 acres, located at 1211 OId Raleigh Road, Annexation No. 803, into the Town Corporate limits.
Motion to adopt a Resolution Directing the Town Clerk to Investigate Petition Received, to accept the Certificate of Sufficiency by the Town Clerk, and to adopt a Resolution Setting the Date of a Public Hearing for August 26, 2025, on the Question of Annexation - Apex Town Council's intent to annex 26.218 acres, project commonly known as “Townes on 1011”, located on Old US 1 Highway, Annexation No. 804, into the Town Corporate limits.
Motion to approve Budget Ordinance Amendment No. 1 and Capital Project Ordinance No. 2026-1 and appropriating funds for the Cemetery Columbarium project

Motion to approve a payment of Fee-In-Lieu (FIL) of dedication for the Madison Downs Residential MSP at the 2025 rate of $4,244.42 SFD/unit.

Motion to waive building inspections and permitting fees associated with the Utley Farms Historic Home Restoration and Preservation project located at 3720 Old Use 1 Highway, New Hill, North Carolina, for a maximum not to exceed one-thousand dollars ($1,000), and only while the home is under ownership of Capital Area Preservation Inc.
Motion to adopt an ordinance amending Chapter 12, Municipal Utilities and Services, Article II Electricity, Sub Section 12-19 Regulation of Load Management of the Apex Town Code of Ordinances.
Motion to approve an Ordinance amending Section 20-165 with the addition of subsection (d) prohibiting parking on both sides of (1) Burma Drive, (2) Classic Road, (3) Goodworth Drive, (4) Pinnacle Center Drive, (5) Production Drive, and (6) Reliance Avenue, west and south of Ten Ten Road, between the hours of 10:00 p.m. and 6:00 a.m. for the purpose of prohibiting overnight parking, and relabel existing subsection (d) as subsection (e).

PUBLIC FORUM
Public Forum allows the public an opportunity to address the Town Council. The speaker is requested not to address items
that appear as Public Hearings scheduled on the Regular Agenda. The Mayor will recognize those who would like to speak at the
appropriate time. Large groups are asked to select a representative to speak for the entire group.
Comments must be limited to 3 minutes to allow others the opportunity to speak.
PUBLIC HEARINGS
Public hearing and possible motion to amend the Apex Transportation Plan along Hammocks Beach Trail and Mt. Zion Church Road for consistency with the proposed rezoning 24CZ10 Ashburn Planned Unit Development (PUD).
Public hearing and possible motion to amend the Apex Transportation Plan to modify planned bicycle facilities along New Hill Olive Chapel Road in the vicinity of US 64.
Conduct a Public Hearing and possible motion to adopt an Ordinance on the Question of Annexation - Apex Town Council's intent to annex 16.80 acres project entitled Atkins, Hudson, and Davidson Assemblage, located on New Hill Olive Chapel Road, Annexation No. 800, into the Town Corporate limits
This item was continued at the June 24, 2025 Town Council meeting
Public hearing and possible motion concerning Rezoning Application #25CZ06 New Hill Olive Chapel Assemblage and Ordinance. The applicant, Mark Altman, Davidson Homes, LLC seeks to rezone approximately 16.51 acres from Wake County Residential-40 Watershed (R-40W) to Medium Density Residential-Conditional Zoning (MD-CZ). The proposed rezoning is located at 2525, 2529, 2537, 2625, & 2701 New Hill Olive Chapel Rd .

Public Hearing and possible motion to approve a Resolution approving in principle, solely for purposes of meeting the requirements of the Internal Revenue Code and for the Bonds to be Issued by the Public Finance Authority to Grace Christian School, the issuance of Educational Facilities Revenue Bonds (the “Bonds”) by the Authority which in no way obligates the Town for repayment of said bonds or creates any liability to the Town.
