CONSENT AGENDA
All Consent Agenda items are considered routine, to be enacted by one motion with the adoption of the Consent Agenda,
and without discussion. If a Council Member requests discussion of an item, the item may be removed from the
Consent Agenda and considered separately. The Mayor will present the Consent Agenda
to be set prior to taking action on the following items:
Motion to approve Agreement for Entry with North Carolina Department of Transportation to enter parcel owned by Town between Pearson Farms and Ashley Downs subdivisions for the purpose of replacing a stormwater culvert across Olive Chapel Road.
Motion to ratify an oral amendment to the existing Design Services Agreement between the Town of Apex and Hobbs Architects, P.A. for additional Construction Administration and inspections required for the Mason Street Municipal Building construction project.
Motion to adopt a Resolution Directing the Town Clerk to Investigate Petition Received, to accept the Certificate of Sufficiency by the Town Clerk, and to adopt a Resolution Setting the Date of a Public Hearing for September 23, 2025, on the Question of Annexation - Apex Town Council's intent to annex 51.822 acres, project commonly referred to as Jessie Drive Industrial, located at 0 East Williams Street (PIN 0751-20-1670), Annexation No. 806, into the Town Corporate limits.
Motion to approve Budget Ordinance Amendment No. 3 appropriating funds for Eva Perry Library roof repairs, data mining and legal review services, cemetery niches, and the correction of the General Debt Service allocation.
Motion to approve an Encroachment Agreement between the Town of Apex and property owners: Gretchen Sutton Hassell, Margaret Michelle Pena, and Eric Ranier Pena, located at 1167 Rothwood Way, Apex, NC 27502, to install a fence and gate that will encroach 80 linear feet (LF) onto the public utility easement, and authorize the Town Manager, or their designee, to execute on behalf of the Town.
Motion to approve the Apex Tax Report dated August 15, 2025
UPDATES BY TOWN MANAGER
Receive as information an update on the Town's Utility Billing Program and provide direction to staff as appropriate.
REGULAR MEETING AGENDA
Mayor Gilbert will call for additional Agenda items from Council or Staff and set the
Regular Meeting Agenda prior to Council actions.
PRESENTATIONS
Kimberly Pressley, Girl Scout Troop 619 Leader
Recognize members of Girl Scout Troop No. 619 for being awarded the Silver Award, which is the highest award a Girl Scout Cadette (grades 6-8) can earn, for their work in beautifying Scott’s Ridge Elementary School.
Proclamation recognizing Hispanic Heritage Month 2025 which shall be observed beginning Monday, September 15, 2025 through Wednesday, October 15, 2025 in the Town of Apex and urge all residents to participate in the upcoming events to learn more about Hispanic history and culture and experience the joy these celebrations bring.
Proclamation recognizing the Month of October 2025 as Italian American Heritage Month in the Town of Apex and encourage residents to join us in celebrating the rich Italian Culture in our town and in honoring the life and legacy of Mrs. Toni Koytek, a pioneer in the Italian American community.
Proclamation recognizing Thursday, September 11, 2025, as Patriot Day in the Town of Apex and encourage all residents to never forget the horrific events of September 11 (9/11), and show respect and appreciation for the first responders in Apex and around the country that give so much of themselves to protect others!

PUBLIC FORUM
Public Forum allows the public an opportunity to address the Town Council. The speaker is requested not to address items
that appear as Public Hearings scheduled on the Regular Agenda. The Mayor will recognize those who would like to speak at the
appropriate time. Large groups are asked to select a representative to speak for the entire group.
Comments must be limited to 3 minutes to allow others the opportunity to speak.

NEW BUSINESS
Discussion and possible motion to authorize staff to take the steps necessary to create the legal structure of a Town-sponsored community land trust to hold and develop land for affordable and mixed-income housing and mixed-use development.
Possible motion to approve an update to the Façade Grant Program to add a pre-authorization step to the Tier 3 grant process, and,
Possible motion to provide pre-authorization for Tier 3 grant proposals submitted by La Farm, and,
Possible motion to provide pre-authorization for Tier 3 grant proposals submitted by Scratch.
Possible motion to appoint one (1) corporate limit resident, over the age of eighteen (18), to serve on the Culture and Arts Advisory Board for the Town of Apex.
Possible motion to appoint one (1) corporate limit residents, over the age of eighteen (18), to serve on the Multimodal Transportation Advisory Board (MTAB) for the Town of Apex.
Possible motion to appoint one (1) voting youth representation, between the ages of 16-18, who resides in the Corporate Limits for the Town of Apex, to serve on the Multimodal Transportation Advisory Board (MTAB) for the Town of Apex.
Possible motion to appoint one (1) voting corporate limit residents, over the age of eighteen (18), to serve on the Planning Board for the Town of Apex, to fill a partial term through December 31, 2024.
Possible motion to appoint one (1) non-voting youth position, who resides in the Corporate Limits for the Town of Apex, to serve on the Planning Board for the Town of Apex.
