CONSENT AGENDA

All Consent Agenda items are considered routine, to be enacted by one motion with the adoption of the Consent Agenda,
and without discussion. If a Council Member requests discussion of an item, the item may be removed from the
Consent Agenda and considered separately. The Mayor will present the Consent Agenda
to be set prior to taking action on the following items:

  A Motion to call for a Public Hearing on August 23, 2022 concerning the extension of the bond order for the $15,000,000 Street and Sidewalk Public Improvement Bonds.

  Motion to adopt a Resolution Directing the Town Clerk to Investigate Petition Received, to accept the Certificate of Sufficiency by the Town Clerk, and to adopt a Resolution Setting the Date of a Public Hearing for August 23, 2022, on the Question of Annexation - Apex Town Council's intent to annex 23.92 acres, Adams Property PUD, Annexation No. 733 into the Town Corporate limits.

  Motion to adopt a Resolution Directing the Town Clerk to Investigate Petition Received, to accept the Certificate of Sufficiency by the Town Clerk, and to adopt a Resolution Setting the Date of a Public Hearing for August 23, 2022, on the Question of Annexation - Apex Town Council's intent to annex 7.21 acres, 905 Wimberly Road, Annexation No. 737 into the Town Corporate limits.

  Motion to adopt a Resolution Directing the Town Clerk to Investigate Petition Received, to accept the Certificate of Sufficiency by the Town Clerk, and to adopt a Resolution Setting the Date of a Public Hearing for August 23, 2022, on the Question of Annexation - Apex Town Council's intent to annex 6.524 acres, Triad Education Services (TMSA), Annexation No. 739 into the Town Corporate limits.

• CN5Jeffrey Maynard, Interim Fire Chief

  Motion to approve the Memorandum of Understanding (“MOU”) between Wake Technical Community College and the Town of Apex to provide Emergency Medical Training (EMT) training for the Town of Apex’s fire academy and authorize the Town Manager to execute the agreement on behalf of the Town.

  Motion to approve the Statement of the Town Council and Ordinance for Rezoning Case #22CZ05 Morris Tract PUD, Brendie Vega, WithersRavenel, petitioner, for the properties located at 0, 7208, 7208-B, & 7304 Morris Acres Road (PINs 0732295017, 0732289587, 0732382530, & 07323827).

  Motion to approve the Statement of the Town Council and Ordinance for Rezoning Application #22CZ11 1522 Salem Church Rd, Joshua Blackley, petitioner, for the property located at 1522 Salem Church Road (PIN 0743815090).

• CN8Liz Loftin, Senior Planner

  Motion to set Public Hearing for the August 23, 2022 Town Council meeting regarding Rezoning Application #22CZ08 Adams Property PUD and Ordinance.  The applicant, M/I Homes of Raleigh, LLC, seeks to rezone approximately 23.92 acres from Wake County Residential- 40W (R-40W) to Planned Unit Development-Conditional Zoning (PUD-CZ). The proposed rezoning is located at 0, 0, 8820 New Hope Farm Road; 8841 & 8833 Twin Ponds Lane.

  Motion to set Public Hearing for the August 23, 2022 Town Council meeting regarding Rezoning Application #22CZ10 Calyx Senior Living Apex (KOBRA PUD Amendment).  The applicant, TMTLA Associates, seeks to rezone approximately 5.738 acres from Planned Unit Development- Conditional Zoning (PUD-CZ #20CZ04) to Planned Unit Development-Conditional Zoning (PUD-CZ). The proposed rezoning is located at 7501 Jenks Road.

• CN10Lauren Staudenmaier, Planner II

  Motion to set Public Hearing for the August 23, 2022 Town Council meeting regarding Rezoning Application #22CZ14 905 Wimberly Road and Ordinance. The applicant, Evan Bost, Bost Custom Homes, seeks to rezone approximately 7.21 acres from Wake County Residential-80W (R-80W) to Residential Agricultural-Conditional Zoning (RA-CZ). The proposed rezoning is located at 905 Wimberly Road.

• CN11Amanda Bunce, Current Planning Manager

  Motion to set Public Hearing for the August 23, 2022 Town Council meeting regarding Rezoning Application #22CZ15 Carspace Apex. The applicant, Chris Rurkowski, TMTLA Associates seeks to rezone approximately 6.92 acres from Tech/Flex-Conditional Zoning (TF-CZ #14CZ30) to Light Industrial-Conditional Zoning (LI-CZ). The proposed rezoning is located at 1720 & 1740 Pinnacle Center Drive.

• CN12Mitchell McKinney, Deputy Police Chief 

  Motion to declare one (1) badge and (1) service weapon (Glock Model 17 9mm handgun, Serial Number XTA-794) as surplus property; and, award to Retiring Sgt. Michael Garafalo who retired from the Apex Police Department on June 1, 2022.

  Motion to set the Public Hearing for the August 23, 2022 Town Council meeting regarding various amendments to the Unified Development Ordinance (UDO).

• CN14Russell Dalton, Traffic Engineering Manager

  Motion to approve an amendment to Traffic Schedule I and Traffic Schedule II of the Town of Apex Code of Ordinances in accordance with the provisions of Sections 20-60.1, 20-68, 20-69, and 20-70.

REGULAR MEETING AGENDA

Mayor Gilbert will call for additional Agenda items from Council or Staff and set the
Regular Meeting Agenda prior to Council actions.

PUBLIC FORUM

Public Forum allows the public an opportunity to address the Town Council.  The speaker is requested not to address items
that appear as Public Hearings scheduled on the Regular Agenda.  The Mayor will recognize those who would like to speak at the
appropriate time.  Large groups are asked to select a representative to speak for the entire group.
Comments must be limited to 3 minutes to allow others the opportunity to speak.

  Conduct a public hearing and possible motion to adopt an Ordinance on the Question of Annexation - Apex Town Council's intent to annex 1302 North Salem Street containing 0.4937 acres, Annexation No. 729 into the Town's corporate limits.

• PH3Dianne Khin, Director of Planning and Community Development 

  Conduct a public hearing and possible motion to adopt an Ordinance on the Question of Annexation - Apex Town Council's intent to annex 71.543 acres, for the Huxley Master Subdivision Plan (MSP), Annexation No. 736 into the Town's corporate limits.
